Is your HR department drowning in paperwork, and are employees signing contracts during onboarding instead of focusing on their work from day one? Find out how to legally maintain an electronic file, sign employment contracts entirely digitally, and digitize existing records—in compliance with the Labor Code and without legal risk.
Are electronic personnel files legal?
Yes—as of January 1, 2019, the amended Labor Code (Article 94(9a) and Articles 94⁸–94¹² of the Labor Code) gives employers complete freedom to conduct employee records in electronic form. An electronic document is, by law, equivalent to the paper version (Art. 94¹¹ of the Labor Code) — this is not a „worse” option, but a fully valid alternative.
What does this mean in practice?
- The electronic file replaces the paper one — The employer is not required to maintain both at the same time.
- Retention period amounts to 10 years From the end of the calendar year in which the employment relationship ended — for employees hired on or after January 1, 2019. For employees hired between 1999 and 2018, the period is 50 years, unless the employer submits OSW and RIA forms to ZUS (in which case it is 10 years); for employees hired before 1999, the period is always 50 years.
- The electronic file must be stored in a manner that ensures the integrity, availability, and confidentiality of the data—which naturally goes hand in hand with the requirements GDPR.
- An employee (including a former employee) may, upon request, receive a copy of their personnel file (Article 94¹² of the Labor Code).
Keeping records electronically instead of on paper isn't just a matter of convenience—it's a real office space savings, archiving costs, and the time HR spends searching for documents. For companies with hundreds or thousands of employees, the difference is enormous.
Can an employment contract be signed with a qualified digital signature instead of on paper?
Yes—and it's completely legal. Article 78¹ of the Civil Code provides that an electronic form with a qualified electronic signature is equivalent to a written form. Since the Labor Code requires employment contracts to be in writing (Art. 29, § 2 of the Labor Code), and an electronic form with a QES meets this requirement, an employment contract can be concluded entirely digitally—without a single sheet of paper.
A key detail that many HR departments overlook: Not every electronic signature is sufficient.
| Signature Type | Equivalent to a written form? | Is this appropriate for an employment contract? |
|---|---|---|
| Qualified Electronic Signature (QES) | ✅ Yes (Article 78¹ of the Civil Code) | ✅ Yes |
| Trusted Signature (Trusted Profile) | ❌ No (documentary form) | ❌ Does not meet the requirement |
| Personal Signature (e-dowód) | ❌ No (documentary form) | ❌ Does not meet the requirement |
| Handwritten signature on a scan | ❌ No | ❌ No |
Using a trusted digital signature for an employment contract is a mistake, though it does not render the contract invalid—the written form of an employment contract is not required under penalty of invalidity. However, the employer must then confirm the terms of the agreement to the employee in writing before allowing the employee to begin work, and failure to do so constitutes an offense punishable by a fine of between 1,000 and 30,000 PLN (Art. 281 § 1(2) of the Labor Code). Check out the difference between signatures in our guide: Trusted Profile vs. Qualified Digital Signature — Differences.
When is QES particularly useful?
- Remote Onboarding — The employee signs the contract before the first day of work, without having to be physically present at the office.
- Hiring Foreign Workers — A foreign employee can obtain a QES online (e.g., through IDnow); the contract is sent to him electronically; he signs it from his country, and you sign it from your desk. More: Qualified digital signature for a foreign national.
- Hybrid and Remote Work — There's no need to have an employee come to the office to sign the document.
- Multi-branch companies — HR signs at headquarters, and the employee signs in their own city; everything is done digitally, without a courier.
How to Sign a Contract Remotely — Step by Step
The process of electronically signing an employment contract is simpler than it might seem. Here is the standard procedure:
- Prepare the contract in PDF format (or as an editable document) and make sure it includes all required elements (including the parties, type of contract, type of work, place of work, compensation, hours of work, and start date—Article 29, § 1 of the Labor Code).
- Sign the QES agreement from the employer — in the app SimplySign All it takes is a few clicks and confirmation on your phone.
- Send to an employee a signed file (e.g., via an HR system, email, or a document signing platform).
- The employee signs with their QES — If they don't have one, they can get one; as an authorized Certum partner, we can assist them with that.
- Both parties have a signed copy — A PDF file with two qualified digital signatures. It is added to the employee's electronic file.
The entire process takes about a dozen minutes and doesn't require a printer, scanner, or courier.
What about documents signed by an employee?
An employment contract isn't the only document an employee signs. There are many more documents that end up in the electronic file. How should you handle the other documents?
Documents Requiring a QES (Written Form)
- Employment Contract and its annexes — as described above.
- Termination of the Contract — in writing (Art. 30, § 3 of the Labor Code); since it is filed by one party, a QES is sufficient.
- Non-Competition Agreements — in writing, under penalty of nullity → QES.
- Joint Liability Agreements — as above (Section 125 of the Labor Code).
Documents for which a written form is sufficient
- PIT-2 (tax return) — it must be submitted in writing or by another method accepted by the relevant tax authority; for example, a form in the HR system is sufficient.
- Vacation Requests — Any format: email or a form in the HR system. As of January 27, 2026, the Labor Code explicitly permits the electronic submission of, among other things, requests for unpaid leave or time off in lieu of overtime.
- Personal Questionnaires — A written document is sufficient.
How can I digitize existing paper personnel files?
Do you already have employees and stacks of paper files? You can convert them to electronic format—but simply scanning the documents isn't enough.
Converting paper documentation to electronic form requires:
- Scans each document must be of a quality that allows its content to be easily read (the minimum requirements and metadata are specified in the regulation on employee records).
- Dressings digital mapping a qualified signature or the employer's seal, or a qualified signature of an authorized person (e.g., an HR specialist) — this confirms that the scan matches the paper original (Art. 94⁸ § 2 of the Labor Code).
- Informing Employees regarding the change in the format of the documentation and the option to receive a paper copy within 30 days (Article 94⁹ of the Labor Code).
- Storage files in a system that meets the requirements for integrity and availability.
This step—verifying the scans—is precisely the area where qualified seal works best (see the next section).
Qualified Digital Seal vs. E-File: What Are They Used For?
Qualified Electronic Seal (QSeal) It is the electronic equivalent of a company stamp: it confirms that the document originates from your company (legal entity) and has not been altered — eIDAS It carries with it a presumption of the authenticity of the data's origin and integrity. In the context of HR, it proves useful in two situations:
- Mass Digitization of Records — Instead of the tedious process of having an HR employee with a QES sign each scan, a qualified seal allows for the automated certification of hundreds of documents at once (as expressly provided for in Article 94⁸, § 2 of the Labor Code). Ideal for „paper-to-digital” migration projects.
- Issuance of Certificates — When a company issues employment or earnings certificates electronically, the company seal confirms their origin without the signature of a specific individual. It is safer to affix a qualified digital signature from an authorized person to an employment certificate issued electronically.
The podpisano.pl lineup includes two options: SimplySign qualified electronic seal (cloud-based, for automation) and Certum Mini (card with a reader). More about stamps and their uses in automation: Qualified Seal QSeal — KSeF and Automation.

Summary
Electronic personnel files and qualified digital signatures aren’t a futuristic vision—they’re tools that are available right here and now. Polish labor law gives your HR department complete freedom—provided you use the appropriate signatures.
- ✅ You will sign your employment contract electronically using QES only (not a trusted signature) — an electronic form with a QES is equivalent to a written form pursuant to Article 78¹ of the Civil Code.
- ✅ An electronic file is fully legal and equivalent to a paper file — Article 94(9a) and Articles 94⁸–94¹² of the Labor Code; a 10-year retention period for employees hired on or after January 1, 2019.
- ✅ Digitizing paper records requires a QES or a qualified seal — A scan alone, without a certification of conformity, does not alter the nature of the documentation and does not replace the paper original.

Frequently Asked Questions (FAQ)
Can an employment contract be signed with a qualified digital signature instead of on paper?
Yes—a qualified electronic signature (QES) confers on an electronic form the same legal effect as a written form under Article 78¹ of the Civil Code. An employment contract signed by both parties using a QES is fully valid and does not require any paper document.
Is a trusted digital signature sufficient to sign an employment contract?
No. A trusted signature only provides documentary form, not written form—a qualified electronic signature (QES) is required for an employment contract concluded electronically. A contract with a trusted signature will not be invalid, but the employer must confirm the terms and conditions to the employee in writing before allowing them to begin work; otherwise, the employer commits an offense.
How long must electronic personnel files be retained?
For employees hired on or after January 1, 2019 — 10 years from the end of the calendar year in which the employment relationship ended. For employees hired between 1999 and 2018—50 years, unless the employer submits the OSW and RIA forms to ZUS (in which case, 10 years). For employees hired before 1999, the period is always 50 years.
Is it possible to maintain both an electronic file and a paper file at the same time?
This is neither required nor recommended. After switching to electronic records, the employer is not required to maintain paper files. It is essential to properly transfer the records (scan + qualified digital signature or the employer’s seal, or the signature of an authorized person) and to inform employees of the change and their option to receive a paper copy within 30 days.
Does an employee need to have their own qualified digital signature to sign a contract electronically?
Yes—to provide a signature that satisfies the written form requirement, an employee needs their own QES. As an authorized partner of Certum, we can help employees (including foreign nationals) obtain a qualified electronic signature, including through online identity verification (IDnow).
What is the purpose of a qualified seal in HR?
A qualified seal is an electronic company seal used by an employer (as a legal entity)—useful for mass certification of scanned paper documents during digitization and for the electronic issuance of employment and earnings certificates. It replaces the HR manager’s signature when processing large volumes of documents; however, it is safer to affix the qualified signature of an authorized person to an electronic employment certificate.
