REGULATIONS OF THE INTERNET STOREpodpisano.pl

I. Definitions

The terms used in the Regulations shall mean:

a) Customer -a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who makes an Order from the Store;

(b) Civil Code -the law of April 23, 1964 (Journal of Laws No. 16, item 93 as amended);

c) Terms and Conditions -these Regulations for the provision of electronic services in the podpisano.pl;

d) Online Store (Store)- the Internet service available at https://podpisano.pl, through which the Customer may, in particular, place Orders;

e) Goods-the products presented in the Online Store;

f) Contract of sale-contract of sale of Goods within the meaning of the Civil Code, concluded between Podpisano sp. z o.o. - owner of the podpisano.pl - and the Customer, concluded using the website of the Store;

(g) Law on Special Terms of Consumer Sales -the Law of July 27, 2002 on Special Terms of Consumer Sales and Amendments to the Civil Code (Journal of Laws No. 141, item 1176, as amended);

h) Law on Providing Services by Electronic Means -Law of July 18, 2002 on Providing Services by Electronic Means (Journal of Laws No. 144, item 1204, as amended);

i) Order -a declaration of will of the Customer, aiming directly at the conclusion of the Sales Agreement, specifying in particular the type and number of Goods.

II. General Provisions

2.1 These Regulations set out the rules for the use of the online store available at https://podpisano.pl.

2.2 These Rules and Regulations are the rules and regulations referred to in Article 8 of the Law on Provision of Electronic Services.

2.3 The online store, operating at https://podpisano.pl is operated by Podpisano sp. z o.o., with its registered office at ul. Wiślana 8, 00-317 Warsaw. NIP: 5252892153. KRS : 0000946614. REGON: 521013396.

2.4 These Regulations set forth in particular:

2.4.1. rules for registration and use of an account within the online store;

2.4.2. terms and conditions for placing electronic Orders within the online store;

2.4.3. the principles of concluding Sales Contracts using the services provided by the Internet Store;

2.4.4. terms and conditions for making electronic reservations of appointments for the performance of services available through the online store.

2.5 In order to use the online store, the customer should on his own access to a computer workstation or terminal device, with Internet access.

2.6 In accordance with applicable laws Podpisano sp. z o.o. reserves the right to limit the provision of services via the Internet Shop to persons 18 years of age or older. In such case, potential customers will be notified of the above.

2.7 Customers may access these Terms and Conditions at any time through the link provided on the home page of https://podpisano.pl and download and take a printout.

2.8 Information about the Goods provided on the Store's websites, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, as defined by Article 71 of the Civil Code.

 

III. Rules of using the Online Store

3.1 The condition to start using the Online Store is to register with it.

3.2 Registration takes place by completing and accepting the registration form, made available on one of the pages of the Store.

3.3 The condition of registration is to agree to the content of the Regulations and provide personal data marked as mandatory.

3.4. Podpisano sp. z o.o. may deprive the Customer of the right to use the Internet store, as well as may restrict the Customer's access to part or all of the resources of the Internet store, with immediate effect, if the Customer violates the Regulations, and in particular if the Customer:

3.4.1. provided data during registration in the online store that is untrue, inaccurate or outdated, misleading or violating the rights of third parties,

3.4.2. committed, through the online store, a violation of the personal rights of third parties, in particular the personal rights of other customers of the online store,

3.4.3. has engaged in other behavior that is deemed by Podpisano sp. z o.o. to be in violation of applicable laws or general rules of Internet use or detrimental to the good name of [host name].

3.5 A person who has been deprived of the right to use the online store may not register again without the prior consent of Podpisano Ltd.

3.6 In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store shall take technical and organizational measures appropriate to the degree of security threat to the services provided, in particular, measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.

3.7 In particular, the customer shall:

3.7.1. not to provide or transmit content that is prohibited by law, such as content that promotes violence, defamatory or infringes on the personal rights and other rights of third parties,

3.7.2. use the Online Store in a manner that does not interfere with its operation, in particular through the use of specific software or devices,

3.7.3. not to take actions such as: sending or posting unsolicited commercial information (spam) within the Internet Store,

3.7.4. use the Internet Shop in a manner that is not onerous for other customers and for Podpisano sp. z o.o.

3.7.5. use any content posted on the Online Store only for your own personal use,

3.7.6. use of the Online Store in a manner consistent with the provisions of the laws in force on the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general rules of Internet use.

 

IV. Procedure for conclusion of the Sales Agreement

4.1 In order to conclude a Sales Agreement through the Online Store, one should go to the website https://podpisano.pl to select goods and services from the Store's offer, taking further technical actions based on the messages displayed to the Customer and information available on the website.

4.2 The Customer's selection of ordered Goods is made by adding them to the shopping cart.

4.3 In the course of placing an Order - until pressing the "Order" button. - The Customer has the possibility to modify the entered data and in the selection of Goods. To do this, follow the messages displayed to the Customer and the information available on the site.

4.4 After the Customer using the Online Store has provided all the necessary data, a summary of the submitted Order will be displayed. The summary of the submitted Order will contain information regarding:

4.4.1. the subject of the contract,

4.4.2. the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),

4.4.3. the selected payment method,

4.4.4. the selected method of delivery,

4.4.4. delivery time,

4.5.1. the agreed date and place of service.

4.5 In order to send an Order, it is necessary to accept the content of the Terms and Conditions, provide personal data marked as mandatory and press the "Place Order" button.

4.6. sending of the Order by the Customer constitutes a declaration of will to conclude with Podpisano sp. z o.o. Sales Agreement, in accordance with the content of the Regulations.

4.7 Once the Order has been placed, the Customer will receive an e-mail entitled "Order" containing the final confirmation of all essential elements of the Order.

4.8 The Contract shall be deemed concluded upon receipt by the Customer of the e-mail message referred to above.

4.9 The sales contract shall be concluded in the Polish language, with the content in accordance with the Regulations.

4.10 Order processing time is calculated from the moment of positive authorization of payment, and if the Customer chooses to pay by bank transfer or payment card - from the date of crediting the Seller's bank account.

 

V. Delivery

5.1 The delivery of the Goods is limited to the territory of the Republic of Poland and shall be made to the address indicated by the Customer when placing the Order.

5.2 Delivery of ordered Goods takes place by own transport, courier service or during an appointment with a representative of Podpisano sp. z o.o. Delivery costs will be indicated at the time of placing the Order.

5.3 The delivery period is from 2 to 5 working days counting from the day the Customer sends the Order.

5.4 Customers may access these Terms and Conditions at any time through the link provided on the home page of https://podpisano.pl and download and take a printout.

Recording, securing, making available and confirming to the Customer the significant provisions of the Goods Sales Agreement shall be done by sending to the Customer at the e-mail address provided and by attaching to the parcel containing the Goods a printout of the confirmation, the order specification and the VAT invoice.

 

VI. Prices and payment methods

6.1 The prices of the Goods are given in Polish zloty in net amounts. All other components, including VAT and delivery costs are presented in the shopping cart.

6.2 The customer has the option to pay the price:

6.2.1. by bank transfer to the bank account number PL 30 1140 2017 0000 4302 1285 8672 ,

6.2.2 The online payment service provider for card payments is Autopay S.A.

6.2.3 Payment by payment cards:

6.2.4. payment through PayPal.

VII. Entitlement to withdraw from the contract

7.1 The Customer, who is a consumer within the meaning of Article 221 of the Civil Code, has the right - based on the provisions of the law - to withdraw from a contract concluded remotely, without giving any reason, by making an appropriate statement in writing within 14 days and sending it to the address Podpisano sp. z o.o., ul. Wiślana 8, 00-317 Warsaw specified in these Regulations.

7.2 The 14-day period shall be counted from the day on which delivery of the Goods took place [unless the online store provides services].

7.3 The consumer's right of withdrawal is excluded in the case of:

  • initiate - with the consent of the consumer - the provision of services by podpisano.pl, before the expiry of the period of 14 days from the conclusion of the contract;
  • goods (services) beyond the standard offer of the store, prepared on special order of the customer and tailored to his individual needs;
  • benefits that, by their nature, cannot be reimbursed.

7.4 In the case of withdrawal from a contract concluded at a distance, the contract is considered not concluded. What the parties have provided shall be returned unchanged, unless the change was necessary within the limits of ordinary management. The return should be made immediately, no later than within 14 days. The purchased goods should be returned to the following address:

7.5 Return is possible when the goods are complete, have not been used or damaged in any way. Goods that are factory-protected from opening cannot be returned after the foil has been removed or the protection removed or the box destroyed. Products must be returned in their original, intact packaging.

In order to implement the return, the goods must be protected from the possibility of damage during transport.

7.6 If there is a need for a refund for a transaction made by the customer with a payment card, the seller shall make the refund to the bank account assigned to the payment card of the ordering party" or "The seller shall refund the payment using the same method of payment used by the consumer, unless the consumer has expressly agreed to a different method of refund that does not incur any costs for him.

7.7 The cost of packaging and returning the goods shall be borne by the customer.

 

VIII. Complaints regarding the Goods

8.1 Podpisano sp. z o.o. as a seller is liable to the Customer who is a consumer within the meaning of Article 221 of the Civil Code, for non-compliance with the sales contract of the Goods purchased by this consumer, to the extent specified in the Act on Special Terms of Consumer Sales.

8.2 Complaints, resulting from violation of the Customer's rights guaranteed by law, or under these Regulations, should be addressed to [email protected]. Podpisano sp. z o.o. undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.

 

IX. Complaints regarding the provision of electronic services

9.1 Podpisano sp. z o.o. takes steps to ensure fully correct operation of the Shop to the extent that results from current technical knowledge and undertakes to remove within a reasonable time any irregularities reported by customers.

9.2 The customer is obliged to immediately notify Podpisano sp. z o.o. of any irregularities or interruptions in the functioning of the Internet Shop service.

9.3 Irregularities related to the functioning of the Store the Customer may report in writing to the address: Podpisano sp. z o.o., ul. Wiślana 8, 00-317 Warsaw, by e-mail at [email protected] or by using the contact form.

9.4 In a complaint, the customer should provide his name, mailing address, type and date of occurrence of irregularities related to the operation of the Store.

9.5 Podpisano sp. z o.o. undertakes to consider each complaint within 14 days, and if this is not possible, to inform the customer within this period when the complaint will be considered.

 

X. Final Provisions

10.1 Settlement of possible disputes arising between Podpisano sp. z o. and the Customer, who is a consumer within the meaning of Article 221 of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

10.2 The settlement of possible disputes arising between Podpisano sp. z o. and the Customer who is not a consumer within the meaning of Article 221 of the Civil Code is submitted to the court having jurisdiction over the seat of Podpisano sp. z o.o.

10.3 In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on Providing Services by Electronic Means and other relevant provisions of Polish law shall apply.
