Do non-state entities have to use e-Guarantees?
e-Delivery is not the future - it's the present. But does every company, foundation or association really need to set up an e-Delivery box? We checked what the law says and prepared a practical guide.
What is e-Delivery?
This is the digital equivalent of a registered letter with acknowledgment of receipt. They have the same legal force, guarantee security, confirm the identity of the sender and recipient. They can be set up through gov.pl, but in an expanded version - also with the help of podpisano.pl.
Who is affected by the obligation?
It all depends on who you are and when you were enrolled. Here's what the timetable for the obligation to implement e-Guarantees For non-public entities:
📌 As of January 1, 2025
- public professionals:
- attorneys,
- legal advisors,
- notaries,
- tax advisors,
- restructuring advisors,
- patent attorneys.
- All new entities entering the KRS after 1.01.2025.
📌 As of April 1, 2025
- Non-public entities registered in the National Court Register before 1.01.2025 (e.g., limited liability companies, foundations with operations).
📌 As of July 1, 2025
- Entrepreneurs registered in CEIDG before the end of 2024, who alter entry after 30.06.2025.
📌 As of October 1, 2026
All other CEIDG entrepreneurs registered before 2025, even if they do not make changes to the entry.
Foundations and associations - when must they have e-Delivery?
If a foundation or association is in business (i.e. registered with the National Court Register as an entrepreneur), the obligation applies to them just as it does to any company. They must implement e-Delivery in accordance with the above deadlines.
What about "pure" foundations and associations?
These are organizations that operate without economic activity, which are not registered as entrepreneurs. They belong to the so-called NGOs (non-governmental organizations). Examples:
- ordinary associations,
- Non-profit charitable foundations.
For them, e-Delivery is voluntary. There is no obligation to set them up, but nothing prevents you from doing so for convenience - for example, to receive letters from offices faster.
What happens if you don't have e-Delivery?
You won't get a fine, but communication with the offices will be hindered. If the office sends you an e-Delivery, the system will automatically switch to the so-called. hybrid delivery - the office prints and sends the document by regular mail. This extends the time, increases the risk of mistakes and delays.
The absence of a box can mean:
- missing important deadlines,
- more difficult contact with the administration,
- Problems in dealing with partners who already use e-Guidance.
How do I set up an e-Delivery address?
You can do it yourself or with help - depending on your needs:
Standalone (basic version)
- Go to Business.gov.pl or Gov.pl
- Fill out an online application
- Sign it with a trusted profile, qualified signature or e-card
- Once activated, you will receive an ADE address in the Electronic Address Database
With the help of podpisano.pl (extended version)
- more operational functions,
- The ability to integrate with the company's workflow,
- greater box capacity,
- Simpler administration (e.g., multi-user access, roles, API integrations).
