Do you have to use e-delivery?

Changes in the law: mandatory e-Delivery for government institutions, public trust professions and new companies in Poland from January 1, 2025

As of January 1, 2025, e-Delivery will gradually replace registered mail with acknowledgment of receipt sent until then via the Polish Post. Under the new regulations, government institutions and public trust professions are first to be covered by the e-Delivery obligation. It also applies to new companies that register with the National Court Register and CEIDG.

Scope of e-Delivery obligation

As of January 1, 2025, all members of public trust professions, such as attorneys, legal advisors, tax advisors, restructuring advisors, patent attorneys, and notaries, will have to use the e-Consultation system. Companies registering with the KRS and CEIDG must also have e-Guarantee boxes.
Only companies registered with the KRS and CEIDG before January 1, 2025 have until March 31, 2025 to set up a box.

Objectives of the introduction of e-Delivery

The purpose of introducing mandatory e-claims is to increase the efficiency of correspondence exchange between entrepreneurs and public administration and to simplify legal and judicial communication processes.

The use of e-Delivery enables the instant transmission of documents, eliminates paper documentation, reduces the costs associated with traditional correspondence and increases data security, thanks to the use of advanced encryption methods. In addition, it identifies the sender and recipient and secures indisputable proof of mailing, delivery and acceptance/rejection.

How do you prepare for change?

Companies and public trust professions should start the process of implementing e-Delivery boxes as soon as possible to avoid the last minute and possible difficulties associated with switching to the electronic delivery system. Public trust professions have two boxes: one for private purposes and one for professional purposes.

It is worth taking advantage of the available training programs and technical support offered by e-Guidance providers to facilitate the process of adapting and using the new system to its full potential.

Consequences of not adapting to change

Failure to comply with the new regulations may result not only in difficulties in communicating with public institutions, but also in legal consequences for failing to comply with the current law.
