Is it possible to have two electronic signatures?

In the digital age, we are doing more and more things online. Contracts, declarations, applications - we can sign all these things without leaving home, using an electronic signature. But did you know that there are different types of e-signatures and you can have more than one qualified signature?

Is it possible to have two qualified signatures? And how do they actually differ from "ordinary" electronic signatures?

Types of electronic signatures

The Electronic Signature Act of September 18, 2001(Journal of Laws of 2001 No. 130 item 1450) defines three types of electronic signatures:

  • Electronic signature - the simplest form, data in electronic form that is attached to or logically linked to other data in electronic form and that is used by the signer as a signature (Article 3(10)). Examples include a handwritten signature on a graphics tablet, a scan of a signature, or even clicking "I accept" in the terms and conditions.
  • Advanced electronic signature - that meets additional requirements, including being uniquely assigned to the signer and allowing the signer to be identified (Article 3(11)). An example is the signature used in electronic banking.
  • Qualified electronic signature - a type of advanced electronic signature that is made using a qualified electronic signature creation device and that is based on a qualified electronic signature certificate (Article 3, Section 12 of the Law). This is the only type of e-signature that has the the same legal force as a handwritten signature.

 

Why do you need more than one qualified signature?

Since a qualified electronic signature is equivalent to a handwritten signature, you may be wondering, why do you need more than one? Well, having two (or more) qualified signatures can be useful in the following situations:

  • Separation of life spheres: You may want to separate private and professional matters, using one signature to handle official matters and another to sign company documents.
  • Signing documents on behalf of different entities: If you run several companies or act as a proxy, you may need a separate signature for each entity you represent.
  • Backup: If one of the signatures fails or is lost, the other will serve as a fallback.
  • Different certificates: You can choose qualified signatures issued by different providers, which can be useful if you have technical problems with one of them.

Having two qualified signatures is perfectly legal and can be practical. Remember, however, that each requires a separate certificate and electronic signature device. And most importantly, a qualified signature can only be used by the person to whom it was issued.
